PTI demands the Supreme Court to declare the trial of civilians in military courts null and void.

Islamabad (News Latest, May 27, 2024): A spokesperson for the PTI stated that in any civilized democratic society, there is no place for military courts. The PTI demands from the Supreme Court to declare trials in military courts unconstitutional, as innocent individuals are being unjustly imprisoned in military jails, violating human rights, amidst intense heat.

According to a recent statement by PTI, the issue of hearing intra-court appeals against military courts in the Supreme Court, demand to swiftly advance PTI’s action and call for the declaration of trials in military courts as unconstitutional, despite Supreme Court’s verdicts declaring trials in military courts as unconstitutional, innocent youth have been unjustly imprisoned in military jails for over a year, suffering from state oppression and injustice. The request for the formation of a larger bench for the last hearing of the case on April 24 has been pending for over a month, but the case has not been scheduled for hearing. Individuals held in military custody under unconstitutional conditions are subjected to inhumane treatment, causing severe distress and suffering to their families. In the extreme heat of the season, these innocent individuals are being unlawfully detained in military jails, violating fundamental human rights. Granting a defense ministry employee the status of a judge and allowing trials in military courts by his hand leaves no room for justice in civilian population trials.

In any civilized democratic society, there is no place for military courts or trials in civilian population. Nomination of civilians in fake, fabricated, and false cases and subjecting their military trials to unjustified detention is a shameful series of organized attacks on human rights. The Supreme Court should immediately establish a larger bench to hear the matter of intra-court appeals against military courts and proceed with the case in the manner of the ‘Bail’ case, ensuring the protection of both the Constitution and fundamental rights, and issue orders for the release of individuals in military custody.
