In the ‘Iddah Nikah’ case, the Session Judge has written a letter to the Islamabad High Court requesting the transfer of the case to another court.

In the ‘Iddah Nikah’ case, the appeals of Imran Khan and Bushra Bibi were scheduled for hearing today. Khawar Maneka has expressed a lack of confidence in me twice; therefore, I request that the appeals be transferred to another court.

Rawalpindi (News Latest, May 29, 2024): Islamabad’s District and Sessions Judge Shah Rukh Arjmand has written a letter to the Islamabad High Court to transfer the ‘Iddah Nikah’ case to another court. In the letter, Judge Shah Rukh Arjmand has requested the transfer of the case. The District and Sessions Judge, in a letter to the High Court regarding Khawar Maneka’s request to transfer the case, stated that the plaintiff, Khawar Maneka, has expressed a lack of confidence in him.

The plaintiff, Khawar Maneka, has expressed a lack of confidence in open court, while a similar appeal from the plaintiff has already been dismissed before. The judge further wrote in his letter that the plaintiff and his lawyer have been responsible for unnecessary delays in the case. Khawar Maneka and his lawyers have always tried to disrupt the hearings.

After the objection, it is requested that this case be transferred to another judge.

The High Court should set a timeframe for resolving these appeals. Today, when the hearing began, Khawar Maneka’s lawyer, Rizwan Abbasi, was once again absent. Upon inquiry by Judge Shah Rukh Arjmand, the assistant lawyer informed that he was at the Supreme Court and requested some more time. The judge then directed Rizwan Abbasi to appear in court by 10:30 AM.

Session Judge Shah Rukh Arjmand conducted the hearing on the appeals of PTI founder Imran Khan and Bushra Bibi. During the hearing, Bushra Bibi’s lawyer Usman Gul and the assistant lawyer of the complainant Khawar Maneka’s lawyer, Rizwan Abbasi, were present.

The complainant’s assistant lawyer informed the court that Rizwan Abbasi was to present the arguments and that the records were with him. After Khawar Maneka’s lawyer, Rizwan Abbasi, arrived in court, the judge asked him if he was to present arguments on two points. Lawyer Rizwan Abbasi submitted the decisions of the higher judiciary to the court.

Khawar Maneka stated that he wanted to make some submissions before the court, mentioning that his lawyers could not fully convey what he had experienced.

“I will speak for myself,” said Khawar Maneka. Imran Khan’s lawyer, Usman Gul, responded that Khawar Maneka was disrupting the court proceedings and requested the court to issue a contempt of court notice against him. Khawar Maneka asked the judge to give him just ten minutes. He explained that he came from a rural background and that a fake divorce certificate of his daughter was made on social media. A heated argument ensued in the courtroom between PTI lawyers and Khawar Maneka.

The presiding judge, Shah Rukh Arjmand, asked the lawyers if they wanted to create a scene in the courtroom. Khawar Maneka stated that Imran Khan, being a former Prime Minister, is given leniency, and requested the court to also consider the plight of a common man. He mentioned that his children were unaware of the January 1st nikah and that he had informed them that the iddah period would end on February 14th, and soon after, the nikah would be announced, which indeed surfaced on February 18th.

The court instructed Khawar Maneka to refrain from using inappropriate language about the PTI founder. Khawar Maneka admitted that he had made a mistake in believing that Imran Khan had come for religious purposes. He stated that when the nikah was performed secretly, it became clear that the PTI founder had deceived him in the name of Allah, adding that the PTI founder does not stop involving himself with women. Following Khawar Maneka’s remarks, the supporters in the courtroom started chanting slogans vigorously.

The court directed Khawar Manika to return to the case. PTI lawyer Naeem Panjutha said Khawar Manika has been brought on bail, the court understands what Khawar Manika wants. Session Judge Shah Rukh Arjmand remarked that lack of confidence is being repeated. Lawyer Gohar Ali Khan argued that Imran Khan is in jail, the evidence is complete, the court should announce the decision. Lawyer Usman Gul said that there is complete trust in the court, whatever decision is made will be accepted. The judge remarked that now whatever decision is made will be controversial. District and Sessions Judge of Islamabad Adat Malik heard the appeals of PTI founder and Bushra Bibi against the sentences in the marriage case and left for his chamber without announcing the decision.
